Federal Power Grab: U.S. To Claim Jurisdiction Over ALL U. S. Water

The Senate introduced the Clean Water Restoration Act (S 787 I) on April 2, 2009.

Like many acts of Congress, this bill sounds quite harmless - until you read through the details.  The summary states: "To amend the Federal Water Pollution Control Act to clarify the jurisdiction of the United States over waters of the United States."

This bill is an ammendment to the Federal Water Pollution Control Act (33 U.S.C. 1251 et seq.).  Everywhere in this bill the words "navigable waters' will be replaced with the phrase "WATERS OF THE UNITED STATES."

The bill will now end with the following:

WATERS OF THE UNITED STATES- The term `waters of the United States' means all waters subject to the ebb and flow of the tide, the territorial seas, and all interstate and intrastate waters and their tributaries, including lakes, rivers, streams (including intermittent streams), mudflats, sandflats, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, natural ponds, and all impoundments of the foregoing, to the fullest extent that these waters, or activities affecting these waters, are subject to the legislative power of Congress under the Constitution.'.

If this passes, essentially, Congress will own your water - all the water in the nation.
